Personal Data Administrator
The administrator of personal data collected through http://smartgym.club/ (Web Site) is Platinium Wellness sp. z o.o. headquartered in Kraków at ul. J. Lea 116, 30-133 Kraków, entered into the Register of Entrepreneurs of the National Court Register maintained by District Court for Kraków-Śródmieście in Kraków, 11th Economic Division of the National Court register under entry no. KRS: 0000383004, NIP: 6772356421, REGON: 121499796 (Platinium Wellness), the owner of Smart Gym clubs.
Scope of Information Collected and Used by Platinium Wellness.
Users of the Web Site (User) shall remain anonymous until they resolve otherwise.
Users shall provide their data voluntarily and Platinium Wellness shall advise them that using some of the functionalities of the Web Site is linked with the User’s need to disclose their specific personal data.
Detailed information on the type and scope of the processed personal data are given in the relevant rules concerning individual service types rendered by Platinium Wellness.
Purpose of Personal Data Processing
Personal Data disclosed by Users depending on the basis of their processing as well as the type of functionality and services they are collected and processed in connection with shall be processed for the following purposes respectively:
Provision of electronic services;
Provision of recreational and sports services;
Commercial purposes including marketing;
Recruitment.
Detailed information on the purpose of the personal data processing is given in the rules governing the provision of individual types of services rendered by Platinium Wellness.
Information contained in system logs (e.g. IP address) deriving from the general rules of connections realised through the internet shall be used by Fitness Platinium for technical purposes. Additionally, IP addresses shall be generally used for the purposes linked with statistical information, e.g. about the region.
Subscribing for the Smart Gym Services.
Users may subscribe for the Smart Gym newsletter and to this end they shall provide their name and e-mail address. The data shall be used solely for the purpose of provision or by or upon the order of Platinium Wellness newsletter containing information among other things about current offers and promotions.
The electronic provision of services consisting in registering an account in the Smart Gym system, their management and online booking shall require filling out a form and disclosure of personal data enabling among other things contacts with the User (e.g. e-mail address). The data disclosed on the form shall be processed also in connection with the execution of the agreement on the provision of recreational and sports services.
Information provided on the form shall be used solely for the necessary contacts with our customers, improvement of services provided by Smart Gym and matching them to the client needs.
Users interested in job offers posted on the Web Site may submit their application using the “Apply” button situated next to a particular offer. To this end Users shall provide their names, surnames, e-mail addresses appending them with CVs and motivation letters. The data shall be used solely for recruitment purposes.
Demographic information may also be presented together with the selected operating data (e.g. records in “cookies”) and used for examining User preferences and raising the quality of services provided by Smart Gym in which case the data shall be disclosed without any ID marks (anonymization) and will be stored for the period not exceeding 1 month.
Data Transmission Protection
The form filled out by the User during the enrolment as well as the authorisation process (logging) concerning the User account and Smart Gym resources shall be carried out using a secure SSL protocol, which will significantly increase the Internet data transmission protection.
Any data including the data stored and processed by Platinium Wellness shall be protected by adequate security means satisfying the requirements laid down in the generally prevailing regulations.
Disclosure of Personal Data
Platinium Wellness envisages a possibility of disclosing the processed personal information to entities related to Platinium Wellness personally or by capital.
Depending on the type of functionality of services provided, the basis for the personal data processing shall be the following:
Consent of the individual concerned;
Necessity to process the data in connection with the fulfilment of the agreement on the provision of electronic services or recreational and sports services where an individual concerned is a party to them or where it is necessary to undertake actions prior to the agreement being executed upon request of the individual concerned;
The necessity to process the personal data to comply with the legally justified purposes carried out by Platinium Wellness or data recipients including in particular for the purpose of direction marketing of own products or services of Platinium Wellness, and where the processing is not in breach with the personal rights and freedom of the individual concerned.
Platinium Wellness advises that in order to ensure compliance with the personal data protection as per the Act of 29 August, 1997 on Personal Data Protection (i.e. Journal of Laws of 2016 item 922 as amended) (the Act), it appointed the Information Security Administrator and in so far as required under the prevailing regulations it has registered the data set with the register maintained by the Inspector General for Personal Data Protection.
An individual whose personal data are processed by Platinium Wellness shall have the right to access the content of their personal data and to have them rectified. Furthermore, under Art. 32 section 1 of the Act such an individual shall have, among other things, the right to submit a written, justified request to discontinue the processing of their personal data due to particular circumstances in the event of processing of the data under Art. 23 section 1 item 4 or 5 of the Act (where it is necessary to carry out the tasks specified under the prevailing laws for public good or where it is necessary to satisfy the justified objectives of the data administrator or recipients and the processing does not violate personal rights or freedom of the individual concerned) under Art. 32 section 1 item 8 of the Act shall have the right to object to having their personal data processed for marketing purposes or transferred to another data administrator.
“Cookies”
As “cookies” shall be construed IT data particularly text files stored on end devices of Users intended for Internet browsing. These files allow to recognize the user device and display the Web Site adapted to their individual preferences. “Cookies” usually contain the name of the Web Site from which they originate, the time of storage on end device and unique number.
Platinium Wellness uses the following types of “cookies”:
Necessary – enabling the use of services available within the Web Site including among other things files supporting the session after logging onto the Smart Gym account;
Functional – enabling remembering of the selected setting having effect on personalisation of the web Site interface;
Security files – supporting the security;
Performance files – enabling collection of information about the manner of Web Site use.
As a standard, the software used for browsing web sites including the Web Site, by default, admits storage of “cookies” on end device. These settings may be changed by Users at any time so as to block automatic service of “cookies” browser settings or advise of each submission to User device. Detailed information on the possibilities and manner of service of “cookies” is available in software setting (of the web browser) used by the User.
Restrictions introduced by the User in the application of “cookies” may affect some functionalities of the Web Site including possibility of provision of electronic services.
